Terms of Service

These Terms of Service ("Terms") govern your use of fata: the learning application available at fata.app and on iOS and Android, the fata.dev website, and related services (collectively, the "Service"). The Service is operated by 14734696 CANADA INC ("fata.dev," "we," "us," or "our"), 720 Luc Street, Ottawa, K1K 3M6 ON, CANADA.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

fata helps developers learn and practise programming through courses, slides, quizzes, coding exercises, a daily quiz, and social features such as friends, challenges, kudos and leaderboards. Some features, such as the daily quiz, can be used without an account; others require one.

We continually improve the Service and may add, change or remove features at any time. We may interrupt the Service for maintenance and will try to keep interruptions short.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf.

3. Your Account

You can sign in with Google, Apple, or a link sent to your email address. You are responsible for keeping access to that sign-in method secure and for all activity under your account. Tell us promptly at [email protected] if you believe your account has been used without your permission.

You must provide accurate information and may not create accounts in someone else's name or create accounts to obtain rewards you are not entitled to.

You can delete your account and its data at any time from Settings > Account in the app. Deletion is permanent and cannot be undone.

4. Subscriptions and Pro Access

The core of the Service is free. Some content and features are available only with a paid Pro subscription.

  • Purchases through app stores. Pro subscriptions are sold through the Apple App Store and Google Play. Your purchase is also subject to that store's terms. Prices are shown in the app before you buy.
  • Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the period ends. You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting your fata account does not cancel a subscription.
  • Refunds. Payments are processed by Apple or Google, and refund requests are handled by them under their policies.
  • Organization access. Pro access may be provided by an organization that has purchased seats for its members. It lasts while the organization keeps your seat.
  • Granted access. Pro access may also be granted for a limited time through challenges, partner programmes or the FATA School association. It lasts for the period stated when it is granted and ends automatically.

5. Acceptable Use

You agree not to:

  • Manipulate or falsify your progress, XP, streaks, rankings or challenge results, including by using automated tools or multiple accounts;
  • Abuse referral, reward or challenge programmes;
  • Harass, impersonate or harm other users, or choose a username or submit content that is offensive, unlawful or infringes someone else's rights;
  • Access the Service through automated means, scrape its content, or place an unreasonable load on our infrastructure;
  • Attempt to bypass security or access controls, or access other users' data;
  • Copy, resell or redistribute course content outside the Service;
  • Use code-execution features to run malicious code or to attack any system.

We monitor activity to detect cheating and abuse. We may remove affected results from leaderboards and other public surfaces, revoke rewards obtained in breach of these Terms, and suspend or terminate accounts involved.

6. Learning Content

Course content, including explanations, exercises and code samples, is created with the help of automated tools, including AI. We work to keep it accurate but cannot guarantee that it is complete, current or error-free. Content is provided for educational purposes only and is not professional advice. Test any code before relying on it in your own projects.

7. Intellectual Property

The Service and its content, including courses, text, graphics, logos and software, are owned by fata.dev or its licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own learning, in accordance with these Terms.

You keep ownership of the content you submit, such as your profile information and answers to exercises. You grant us a worldwide, royalty-free licence to host, store, process and display that content to operate and improve the Service, and to display your username, profile picture, school and rankings to other users on the Service's social features.

8. Third-Party Services

The Service relies on third parties such as Google, Apple and RevenueCat, and may link to external sites and partner platforms. Your use of those services is governed by their own terms. We are not responsible for third-party services.

9. Privacy

Our Privacy Policy explains what data we collect and how we use it. By using the Service, you acknowledge that your data is handled as described there.

10. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or if required by law. Sections 6, 7, 11, 12 and 14 survive termination.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, secure or error-free, or that data synchronized from offline use will never be lost.

12. Limitation of Liability

To the fullest extent permitted by law, fata.dev will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or opportunities, arising out of or related to your use of the Service. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $50.

Nothing in these Terms limits any rights you have as a consumer that cannot be limited under the laws of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you in the app or by email before they take effect. The "Last Updated" date shows when the Terms last changed. If you continue to use the Service after changes take effect, you accept the updated Terms. If you do not agree, you may delete your account and stop using the Service.

14. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Any dispute that cannot be resolved amicably will be submitted to the courts of Ottawa, Ontario, unless the mandatory law of your country of residence gives you the right to bring proceedings elsewhere.
